Terms of Service

§ 1 Scope and Contracting Parties
These General Terms and Conditions (hereinafter "Terms") apply to all contracts between myapimonitor (hereinafter "Provider") and the users (hereinafter "Customer") regarding the use of the software-as-a-service platform myapimonitor (hereinafter "Service").

Deviating terms and conditions of the Customer shall not be recognized unless the Provider has expressly agreed to their validity in writing.
§ 2 Service Description
The Provider offers the Customer a cloud-based SaaS platform via the Internet for monitoring, validating, and forwarding API requests and webhooks in real time. This includes in particular:
- Receiving and logging incoming API requests and webhooks via public endpoints
- Rule-based payload validation (e.g. schema validation, value checks, combined conditions)
- Intelligent forwarding of requests to target systems
- Real-time alerting and email notifications for validation errors
- Address validation and plausibility checks
- Project and team management with role-based access
- Dashboard with request history and analytics
The exact scope of features depends on the plan selected by the Customer (Free, Pro, Pro+, Team). The current features of each plan are available on the pricing page at /pricing.
The Provider is entitled to further develop the Service, adjust or add features, or — for objective reasons — discontinue features, provided the core scope of the booked plan is not significantly impaired.
§ 3 Contract Conclusion and Term
The contract is concluded upon the Customer's registration on the platform and confirmation by email.
Paid plans (Pro, Pro+, Team) commence upon completion of the booking process and successful payment confirmation by Paddle. The terms of use of Paddle (https://www.paddle.com/legal/checkout-buyer-terms) apply additionally to the payment transaction, as Paddle acts as Merchant of Record and processes payments in its own name.
Subscriptions are concluded on a monthly basis and are automatically renewed for an additional month unless cancelled in time.
§ 4 Prices, Payment Terms, and Billing
The applicable prices are listed in the pricing overview at /pricing. All prices are in Euros (€) and, unless otherwise stated, are exclusive of statutory VAT.
Payment processing is handled exclusively by Paddle (Paddle.com Market Limited, 15 Dock Street, London, E1 8JN, United Kingdom, and Paddle.com, Inc., 8 Greenway Plaza, Suite 1500, Houston, TX 77046, USA). Paddle acts as Merchant of Record: Paddle receives payments in its own name, issues invoices, remits VAT, and handles refunds and chargebacks.
The monthly fee is due in advance at the beginning of each billing period. Charges are processed by Paddle using the payment method stored by the Customer with Paddle (e.g. credit card). The terms of use of Paddle (https://www.paddle.com/legal/checkout-buyer-terms) apply additionally to payment processing.
In the event of a failed payment, the Provider is entitled to temporarily suspend access to the paid plan until the outstanding amount has been settled.
The Provider reserves the right to adjust prices with a notice period of at least 30 days before the start of a new billing period. In this case, the Customer has a special right of termination.
§ 5 Termination and Contract Cancellation
Paid subscriptions may be cancelled at any time effective at the end of the current billing period. Cancellation is possible through the account settings or by email to info@myapimonitor.com.
After cancellation, access remains active until the end of the paid period. A pro-rata refund of fees already paid is generally not provided, unless there is a defect attributable to the Provider.
The right to extraordinary termination for good cause remains unaffected. Good cause for the Provider exists in particular if the Customer violates these Terms, applicable laws, or the rights of third parties.
Upon termination, the Customer's data will be deleted in accordance with the Privacy Policy.
§ 6 Right of Withdrawal (Consumers)
Consumers within the meaning of § 13 BGB (German Civil Code) generally have a 14-day right of withdrawal for distance contracts in accordance with Art. 9 of Directive 2011/83/EU (Consumer Rights Directive).
The right of withdrawal expires prematurely if the Provider has begun to provide the service and the Customer has expressly consented to the Provider beginning performance before the expiry of the withdrawal period and has confirmed that they thereby lose their right of withdrawal.
To exercise the right of withdrawal, a clear statement by email to info@myapimonitor.com is sufficient.
§ 7 Usage Rights and Intellectual Property
The Provider grants the Customer a simple, non-transferable right to use the Service within the scope of the booked plan for their own business or private purposes for the duration of the contract.
The software underlying the Service, trademarks, logos, and all other content of the Provider are protected by copyright or other intellectual property rights. Any use beyond the contractually agreed use is prohibited without the express written consent of the Provider.
Data and content uploaded by the Customer to the Service remain the property of the Customer. The Customer grants the Provider the right to process this data for the purpose of providing the Service.
§ 8 Obligations of the Customer
The Customer is obligated to keep their login credentials (username, password) secure and not make them accessible to third parties.
The Customer may not use the Service for illegal purposes or in a manner that violates these Terms or applicable laws.
The Customer is responsible for all activities carried out under their account and is obligated to immediately inform the Provider of any unauthorized use.
The reproduction, redistribution, or public making available of Service content outside the contractually permitted scope is prohibited.
§ 9 Availability and Maintenance
The Provider aims for a Service availability of 99.0% on a monthly average. Excluded from this are planned maintenance work, which the Provider will announce in advance where possible, as well as outages caused by circumstances beyond the Provider's control (force majeure, third-party outages, etc.).
The Provider is entitled to temporarily restrict or interrupt the Service for maintenance and update purposes.
§ 10 Liability
The Provider is liable without limitation for damages arising from injury to life, body, or health, as well as for damages based on intentional or grossly negligent breach of duty by the Provider.
Otherwise, the Provider's liability is limited to typically foreseeable damages. Any further liability of the Provider for simple negligence — with the exception of a breach of essential contractual obligations (cardinal obligations) — is excluded.
Liability under the German Product Liability Act and for fraudulently concealed defects remains unaffected by the above limitations of liability.
§ 11 Data Protection
The collection, processing, and use of personal data is carried out in accordance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR), and the Provider's Privacy Policy, which is available at /privacy.
The Provider processes the Customer's data exclusively for the purpose of providing the Service, unless separate consent has been given.
§ 12 Changes to these Terms
The Provider is entitled to change these Terms with a notice period of at least 30 days. Changes will be communicated to the Customer by email.
If the Customer does not object to the changes within 30 days of receipt of the notification, the amended Terms shall be deemed accepted. The Provider will expressly inform the Customer of this right of objection and the consequences of silence in the notification of changes.
In the event of an objection, the Provider has the right to terminate the contractual relationship at the time the changes take effect.
§ 13 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in another EU Member State, the mandatory consumer protection provisions of that Member State apply insofar as they offer greater protection.
The place of performance and jurisdiction for merchants and legal entities under public law is the Provider's registered office.
Should individual provisions of these Terms be or become invalid, this shall not affect the validity of the remaining provisions.
